Terms of Service

These terms (the "Terms") govern your use of ClutchDay (the "Service"), operated by Kelsey Poulter LLC. By creating an account or using the Service, you agree to these Terms.

1. The Service

ClutchDay is a nutrition-planning and athlete-fueling app. It generates personalized meal plans, schedules, recipes, and related guidance for athletes and their families. ClutchDay is not medical advice and is not a substitute for care from a licensed physician, dietitian, or other qualified professional. Consult a healthcare professional before making significant changes to diet or training, especially if you have a medical condition.

2. Eligibility & accounts

You must be at least 18 years old to create an account. A parent or legal guardian must create and manage any account that includes a child athlete. You are responsible for keeping your login credentials secure and for activity that occurs under your account.

3. Subscriptions, free trial, and billing

Paid access to ClutchDay is sold as a recurring subscription. When you sign up, you may receive a free trial of the length shown at checkout. Your payment method is collected and authorized at the start of the trial, but you are not charged until the trial ends.

When the trial ends, your subscription automatically converts to paid and the price shown at checkout will be charged to your payment method on a recurring monthly basis until you cancel. You can cancel at any time from the "Manage subscription" link on your profile, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period; you keep access until then.

We may change the price or trial length for new subscriptions at any time. Changes to the price of an existing subscription will be communicated to you in advance with the opportunity to cancel before they take effect. Trial length is fixed for the life of any given trial — once your trial has started, we won't shorten it.

Refunds are handled separately under our Refund Policy.

4. Acceptable use

You agree not to:

  • Misuse, disrupt, or attempt to compromise the Service
  • Share your account with anyone outside your immediate household
  • Scrape, resell, or redistribute recipes or program content
  • Use the Service to harass, threaten, or harm anyone
  • Use the Service in violation of any law

We may suspend or terminate accounts that violate these rules. In serious cases we may terminate immediately and without refund.

5. Health and safety disclaimer

Meal plans, calorie and protein targets, hydration guidance, and any coaching content in the Service are generated by software and generalized educational material — they are not individualized medical or dietary advice. Athletes with food allergies, medical conditions, or specialized dietary needs should consult a qualified professional before relying on plans from the Service. Stop using the Service and seek medical attention if you experience any adverse health effects.

6. Intellectual property

ClutchDay, including the app, recipes, plans, course content, and all related branding, is owned by Kelsey Poulter LLC. You receive a limited, non-exclusive, non-transferable license to use it for your household's personal, non-commercial benefit while your subscription is active.

7. Disclaimers & limitation of liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months immediately preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, consequential, special, or punitive damages.

8. Termination

You may stop using the Service and cancel your subscription at any time via your profile. We may suspend or terminate your access for violations of these Terms or for any other reason at our reasonable discretion. Provisions that by their nature should survive termination will survive.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the updated version with a new "last updated" date. Material changes will be communicated to the email on your account. Continued use of the Service after a change means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to that jurisdiction.
